For a period of 8 months there have been registered 165 cases of domestic violence in Fier region. Only 8 women have benefited the economic aid out of 53 that have received the protection order from the law court. The story of the 44 year old woman with a protection order, mother of two children, who has been violated for many years from her husband, and lately from his family members as well.

She lives every day with the fear of the violence and finds herself being unprotected to overcome this. The 44 year old woman with the initials F.M., mother of two children is well-known in the premises of Fier Police for the denouncements she has registered against the violence that have accompanied in her life, exercised by her husband and his relatives. She is one out of the 165 cases identified for domestic violence in Fier region. Her case is well-known even from the first instance court of Fier, which has released a protection order for one year, beginning from February 2014. But, despite the “protection order” of the Albanian justice, she has been again violated from the family members of her husband, with whom she lives under the same roof in Libofshe village, in Fier.
“It is said that when the body dies, the spirit lives, but you have in front of you an alive body with a dead spirit. I have used the same words on the denouncement of my violence at the police premises, and to the court premises as well when I asked the protection order from the justice”, says desperately the violated woman, while starting to tell how the suffering in her life has started. “I have never met the word ‘love’ in my life. I got married in autumn of 1992. We have been a small family, with good economic conditions in this village, but we have been prosecuted during the dictatorial system. I have been three months engaged and after that I got married with my parents‘will. Three days after my marriage I have been maltreated from my husband”, say the 44 year old woman.
The last violance to the 44 year old woman has happened this year, on 14 August. This time, there were the sisters of her ex-husband that have exercised violence on her, at a time that despite the denouncement of the F.M. done to the Police, no measure was taken to protect her. She says that her life is at risk at every moment from her ex husband and his relatives, hence she asks for support from the state including economic support as well, as she does not generate any income to raise alone her two children. “I have asked for support, but I do not trust anyone. This year, on 14 August, his sisters bit me. I did the denouncement. The procedures were followed. Absolutely nothing happened. Nobody called me, nobody asked me. I would like that when I go to the state offices where people think that you can find your rights, to have a better reception and be helped. I live with 2 thousand (old) leke per day. I have to feed two children. I do not have any support; I live at the same dwelling with my violator. I am afraid…” admits the violated woman.
The denouncement that F.M. has done for the violence exercised to her registers the date 31.10.2013 and it is done in the Section for the domestic violence and protection of the infants in the Fier Regional State Police Directorate. After the denouncement, the police have deposited to the Fier First Instance Court the lawsuit for the release of the protection order for the citizen F.M. The Fier Law Court has decided with the Decision No. 62-2014-906 (351), date 20.03.2014, “Acceptance of the lawsuit, release of the protection order, ordering the citizen F.DH. to not threaten, tease, contact, communicate directly or indirectly with the victim F.M., ordering the defendant to allow the citizen F.M. to own together with her children a part of the dwelling that is located in Libofshe commune (a bedroom, living room and the other premises having a common usage. To order the defendant to not come closer to the part of the building that will be used from his wife and to the joint premises during the time that they are used by his wife. This measure lasts for one year.”
The case of the 44 year old woman is also known from the Fier State Social Service Office. The director of this institution, Alba Stefa, says that they are in process of the completion of the file in order F.M. to benefit the economic aid. “Up to now she has been supported as a family under the scheme of the economic aid. The decision of the Council of Ministers No. 376, clearly instructs the way how to support these families. But by the beginning of the year there is done the planning of the budget for the year in progress, based on the data of the previous semi-annual period. In November, the updating of this budget is done for the next year and it is at this moment when the new cases of violence and support for them are also included. This is done due to the fact that no one can foresee if there will be any case of the domestic violence or not”, explains Stefa. Furthermore, she informs that since October and on, there will be prepared the files for the violated women, including the 44 year old woman.
Fier Police Directorate
According to an official communiqué of the Fier Regional State Police Directorate, during the 8 month period of 2014, there have been registered 165 cases of violence that have happened in the families. “53 cases have asked for a protection order to the Fier and Lushnja First Instance Courts, whereas 101 cases are cases of the domestic violence, bases on the article 130/a of the Penal Code”, it is stated in the Police communiqué. According to the data, in two of the cases have also been referred the materials for the penal act of “murder”, at a time that there have also been registered 7 victims, whereas their authors have performed a suicide. Other cases, according to the police are: “A case where the materials for the penal act have been referred for ‘Causing the suicide’, another penal case for ‘Threat’, another one where the referrals are done for the penal act ‘Maltreatment of infants’, two cases for ‘Abandonment of children’, a case for ‘Lack on giving the goods for living’, two cases for ‘Slight wounding’ and a case for ‘Insult’”.
By doing a short analyses of the cases registered in the 8 month period of 2014, based on the lawsuits and referrals, there results that in 77 cases there has been the wife that has deposited the lawsuit to the Court. But there have also been cases where the other members of the family have exercised violence. According to the data, in 8 cases the sisters have denounced the violence exercised by their brothers and in 7 other cases the vice-versa. Furthermore, in 12 cases the violence has been denounced by the children towards their parents and in 29 cases the parents against their children. To all the above mentioned cases of domestic violence, the Fier Police has arrested 51 people, 109 people are under inspection at free, in 2 cases the author has performed the suicide, whereas 3 other people are wanted.
Tens of decisions released by Fier Law Court with the object “Protection order”, after the denouncements done by the violated women, are either not implemented in situ, or in the majority of cases they stipulate that the violated woman “has to live under the same roof with her violator, and moreover she has also to jointly use the premises of the dwelling, under the condition that the husband (violator) must not speak to her, contact, tease or threat directly or indirectly the victim of his violence”.
As if this situation is not enough, the victims of violence, after getting these “protection orders” from the justice they have no way out as they live under very difficult economic conditions, among the fear on suffering a repetition of violence, and lack of attention from the social services. Only 7 cases have benefited the social economic aid from the Fier State Social Service, out of 53 cases that have received a protection order. The injured and victims of violence suffer the lack of residential premises. In Fier region there is a lack of such centers, where the women getting a protection order due to the domestic violence, must live. Based on the data made public from the Fier State Social Service office, only 4 cases from this region are sheltered in the only residential center in the capital city.

When have you been violated from your husband for your first time?
Since the third day of our marriage. I never learned the reason, but jealousy; this is what I have suffered for my whole life and without any reason.
How many times have you been maltreated and violated?
So many times that I cannot remember. My whole life has been like that. I have not felt being important in the family; I have not felt any warmth or love. It’s just simple; he has never called me in my name, a single time at least.
When have you denounced the first time your violence?
Only at the moment when that man got the divorce, and I thought that during my whole life I had undergone his violence, the mentality of the Albanian women and especially in the villages does not make them to raise their voice; they just accept their fate. It has been February 8, 2014 when I denounced the violance on me from that man, because I have thought until that moment that this was my fate, he was the father of my children.
Did the Law Enforcement institutions help you?
Many things are written on the paper, there are said many nice words, but the reality is completely different …
Because from moment to moment I am at risk in the environment that I live; I am surrounded by people who do not love me. Even though I have a piece of paper in my bag (the Court’s decision) it is not worthy at all. I may become a news some day for the first pages of the newspapers. I am very sure for this, as we have heard and seen about the murders of women, I can lose my life as well.
Does your husband still violate and maltreat you?
At the moment, from my ex-husband not, but from his relatives yes.
Have they beaten you.
Yes. I have asked for support, but I do not trust anyone. This has happened again this year, on 14 August, I was beaten from his sisters. I denounced it. They followed the procedures. They absolutely did not do anything. Nobody called me, nobody asked me.
What do you want from the state? Do you get any economic aid?
From the state? More help. I would like to have their support and a better reception any time that I would go to their offices where it is said that you may find your rights. I live with 200 leke per day. I have two children to feed. I do not have the support of anyone, I live at the same building with the violator. I am afraid …
